1.1 Agreement to Terms
By accessing or using TQLeads.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Wicked RC LLC d/b/a TQLeads ("TQLeads," "we," "us," or "our"), a Massachusetts limited liability company.
1.2 Description of Service
TQLeads is a B2B lead generation platform that uses artificial intelligence to help users find, score, and export contact information for business prospects. The Service queries publicly available business directories (including Google Places), applies AI-powered relevance scoring via Gemini AI, and surfaces publicly available contact details including phone numbers, email addresses, and named decision-makers. Users may save searches, build lead lists, and export results as CSV files.
1.3 Eligibility
The Service is available to users worldwide. By accessing or using the Service, you represent that you have the legal capacity and authority to enter into this agreement on behalf of yourself or the business you represent, and that your use of the Service will comply with all applicable laws and regulations in your jurisdiction.
1.4 Account Registration
To access the Service, you must create an account. You agree to provide accurate, complete, and current information during registration and to keep your account credentials confidential. You are solely responsible for all activity that occurs under your account. Notify us immediately at Adam@wickedrc.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
1.5 Subscription, Payment, and Auto-Renewal
The Service is offered on a monthly subscription basis at $25.00 per month, billed through Stripe. IMPORTANT: Your subscription automatically renews each month on your billing anniversary date until you cancel. By subscribing, you authorize TQLeads to charge your payment method on file through Stripe on a recurring monthly basis without further authorization, until you cancel.
All fees are stated in U.S. dollars and are charged at the start of each billing period. We reserve the right to change pricing with at least 30 days' written notice to your registered email address. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.
If a payment fails, we may retry the charge and may suspend or terminate your access to the Service until payment is received.
1.6 Cancellation
You may cancel your subscription at any time through your account settings or by contacting Adam@wickedrc.com. Cancellation stops future automatic renewals and takes effect at the end of your current paid billing period. You retain full access to the Service through the end of that period. Cancellation does not entitle you to a refund for any portion of the current billing period already paid.
1.7 Refunds
All fees are generally non-refundable. Refund requests are reviewed on a case-by-case basis at TQLeads' sole discretion. To request a refund, contact Adam@wickedrc.com with your account information and the reason for your request. TQLeads is under no obligation to grant any refund.
1.8 User Responsibilities and Outreach Compliance
The Service provides contact information for third-party businesses sourced from publicly available records. You acknowledge and agree that:
- You are solely responsible for how you use, contact, and communicate with any prospects or leads obtained through the Service.
- You must comply with all applicable laws governing business outreach, including but not limited to: the CAN-SPAM Act (email marketing), the Telephone Consumer Protection Act (TCPA) (calls and text messages), the General Data Protection Regulation (GDPR) where applicable, and any other federal, state, local, or international laws governing electronic communications, telemarketing, and data privacy.
- TQLeads does not warrant that the contact information surfaced by the Service is accurate, current, or appropriate for your intended use.
- You will not use the Service to harass, spam, defraud, or otherwise harm any individual or business.
1.9 Prohibited Uses
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Scrape, copy, or reproduce the platform's data or functionality beyond your permitted use
- Resell, sublicense, or redistribute lead data in bulk to third parties as a data product
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use automated bots or scripts to access the Service beyond normal use
- Transmit malware, viruses, or any harmful code
- Impersonate any person or entity
1.10 Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
1.11 Disclaimer of Warranties
The service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of data, or non-infringement. TQLeads does not warrant that the service will be uninterrupted, error-free, or that any contact information provided is accurate or current.
1.12 Limitation of Liability
To the fullest extent permitted by applicable law, TQLeads, its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including but not limited to lost profits, lost data, or business interruption, even if advised of the possibility of such damages. Our total aggregate liability to you shall not exceed the greater of $25.00 or the amount you paid us in the three months preceding the claim.
1.13 Indemnification
You agree to indemnify, defend, and hold harmless Wicked RC LLC d/b/a TQLeads, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, including CAN-SPAM, TCPA, or GDPR; or (d) your outreach to any prospect or lead obtained through the Service.
1.14 Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Middlesex County, Massachusetts. You consent to personal jurisdiction in those courts.
1.15 Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Site at least 7 days before they take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
